Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LoyaltyPie mobile applications and related services (the "Service"), operated by Pynology Inc ("Pynology", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

LoyaltyPie provides software that lets businesses ("Businesses") issue digital loyalty cards, class passes, punch cards and memberships to their customers ("Members"), track attendance, and communicate with Members. LoyaltyPie is a software provider only; we are not a party to any transaction between a Business and its Members.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. You must be at least 18 years old to create a Business account.

3. Subscriptions & billing

Businesses pay a recurring subscription fee to use the Service, billed in advance through our payment processor. Fees are non-refundable except where required by law or expressly stated. We may change pricing with reasonable notice; continued use after a change constitutes acceptance.

4. Payments to Businesses

Where a Business collects payments from its Members (for example, memberships or class passes), those payments are processed through the Business's own connected payment provider (such as Stripe). Pynology does not hold or control those funds and is not responsible for a Business's pricing, refunds, or fulfilment of its offers.

5. Acceptable use

You agree not to misuse the Service, including by attempting to disrupt it, access it without authorization, upload unlawful content, or use it to send unsolicited communications. We may suspend or terminate accounts that violate these Terms.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by Pynology Inc and its licensors. These Terms do not grant you any right to our intellectual property except the limited right to use the Service as intended.

7. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Pynology Inc will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Service.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
